# EU influencer-campaign compliance checklist (brands and creators)

\### Before the campaign

\*   Confirm which country or countries the campaign will run in.
\*   Identify the rules that apply, such as France (Loi 2023-451), Italy (AGCom Delibera 197/25/CONS), Spain (Royal Decree 444/2024), Germany (UWG §5a), or the UK (ASA/CAP Code).
\*   Agree on who is responsible for adding the disclosure label.

\### In the agreement

\*   Put the agreement in writing. In France, Décret 2025-1137 requires a written contract for influencer partnerships above €1,000 from 1 January 2026.
\*   Define the deliverables, formats, posting dates, and platforms.
\*   Specify the usage rights and any exclusivity period.
\*   Agree on the fee, payment terms, and payment deadline.

\### Before publishing

\*   Use the correct disclosure for the target market.
\*   Make sure the disclosure is clearly visible.
\*   Apply the disclosure to Stories and short-form videos, not just feed posts.

\### After the campaign

\*   Issue a complete invoice and handle cross-border VAT correctly.
\*   Keep contracts, invoices, and campaign records.
\*   Remember that regulators can issue significant fines. In Italy, for example, AGCom can impose penalties of up to €250,000, or €600,000 when minors are involved.
