EU influencer-campaign compliance checklist (brands and creators)
Before the campaign
Confirm which country or countries the campaign will run in.
Identify the rules that apply, such as France (Loi 2023-451), Italy (AGCom Delibera 197/25/CONS), Spain (Royal Decree 444/2024), Germany (UWG §5a), or the UK (ASA/CAP Code).
Agree on who is responsible for adding the disclosure label.
In the agreement
Put the agreement in writing. In France, Décret 2025-1137 requires a written contract for influencer partnerships above €1,000 from 1 January 2026.
Define the deliverables, formats, posting dates, and platforms.
Specify the usage rights and any exclusivity period.
Agree on the fee, payment terms, and payment deadline.
Before publishing
Use the correct disclosure for the target market.
Make sure the disclosure is clearly visible.
Apply the disclosure to Stories and short-form videos, not just feed posts.
After the campaign
Issue a complete invoice and handle cross-border VAT correctly.
Keep contracts, invoices, and campaign records.
Remember that regulators can issue significant fines. In Italy, for example, AGCom can impose penalties of up to €250,000, or €600,000 when minors are involved.
